The Client :
The client declares to have legal capacity or be in possession of parental authorization allowing them to place an order on the website. When registering the client's personal data in the 'My Account' section, the client must ensure the accuracy and completeness of the mandatory information provided. In case of an error in the client's contact details, The New Elisabeth cannot be held responsible for the inability to deliver the product.
The Product :
The products offered for sale are those listed on the website. The New Elisabeth takes utmost care in presenting and describing these products to best meet the customer's demand. Each product showcased on the site is accompanied by one or several photos and a description, offering customers maximum information before placing an order. These details align with the provisions of Article L.111-1 of the Consumer Code.
The New Elisabeth offers a range of products made on demand. Each piece is handmade by the creator, Clémence Kimbally.
Consequently, the delivery time can vary from 3 to 6 weeks (depending on the ordered piece). Products may be subject to variations in shapes, sizes, and colors, for which The New Elisabeth cannot be held responsible. No piece crafted by Clémence can be identical; each piece created is unique.
The products are sometimes presented in photographs with other items.
Pre-order :
Products from The New Elisabeth are not immediately available for sale. The New Elisabeth aims to minimize waste. When a customer places an order, they receive an order validation via email. The client will receive notifications at each stage of production until the first appointment (product adjustment). Subsequently, they will be informed of the estimated delivery date. Once the product is ready, the order will be shipped.
For all orders, credit cards will be the only accepted payment method. The New Elisabeth will verify the credit card's validity at the time of the order.
Ordering :
Any order placed on the website is subject to complying with the different steps the customer must follow to validate their order. The customer will have the opportunity, before definitively validating their order, to check its details and total price. Any order confirmed by the customer constitutes a sales contract and acceptance of all the general terms and conditions.
The New Elisabeth will not accept any orders from customers with whom there is a dispute or incident related to the payment of a previous order. Should the customer fail to correct erroneous elements or those contrary to these general sales conditions with The New Elisabeth, The New Elisabeth reserves the right not to process the order.
A confirmation email summarizing the order will be sent to the customer by The New Elisabeth. Accordingly, the customer formally accepts the use of electronic mail for confirmation by The New Elisabeth of the contents of their order. Invoices will be provided upon delivery via the customer's email address.
In the event of a product's unavailability, the customer will be informed by email. They can select the 'notify me when this item is available' option and place their order later.
All orders placed at The New Elisabeth are intended for the customer's personal use, and the customer prohibits any partial or total resale of the products.
Prices and Payment Terms :
1. Price Determination
Product prices are indicated in euros, inclusive of all taxes, including shipping fees. The total price of the order (including all taxes and shipping costs) is displayed in the cart.
The New Elisabeth reserves the right to modify prices in case of supplier changes or changes in raw material prices.
2. Payment Methods
The price invoiced to the customer is the price indicated on the order confirmation sent by email. The price of products is payable in full on the day of preparation confirmation.
To settle their order, the customer can choose from the various payment methods offered by the PAYPAL platform and by credit card: Carte Bleue, Visa, Eurocard-Mastercard.
The customer assures The New Elisabeth that they have the necessary authorizations to use the payment method they selected when validating the order. Debit for purchases from the customer's account occurs when the order is being prepared. By choosing the PAYPAL payment platform, The New Elisabeth implements all necessary means to ensure the security and confidentiality of data transmitted online. PAYPAL uses SSL (Secure Sockets Layer) protocol and 128-bit encryption key length (the highest degree currently available in the market), ensuring that the client does not disclose their financial information.
The New Elisabeth reserves the right to suspend order management and delivery in case of refusal of payment authorization by the officially accredited credit card institutions or in case of non-payment.
Delivery :
Delivery is made to the delivery address indicated by the customer, specifying that it must be the customer's residence address or that of any other individual of their choice. Delivery cannot be made to hotels or PO boxes. For practical and ecological reasons, orders with multiple products are sent together in a single shipment via a secure carrier.
The customer must ensure that they have provided accurate and complete information regarding the delivery address (including street number, building, staircase, access code, names and/or intercom number, etc.). The New Elisabeth cannot be held responsible for any input errors and their consequences in terms of delays or delivery errors. In this context, all expenses incurred for re-delivery or re-presentation by the carrier will be the responsibility of the customer.
The delivery times indicated are for guidance only, corresponding to average processing and delivery times. The New Elisabeth cannot be held responsible for consequences resulting from delays in delivery that are beyond its control.
The customer is required to check the condition of the products upon receipt. In the event of damage, they must precisely mention their reservations on the delivery slip and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery, in accordance with the provisions of Article L.133-3 of the Commercial Code.
Once you have reported an incident following delivery, we will contact you to undertake the necessary alterations as soon as possible.
Furthermore, the customer must inform The New Elisabeth by registered letter with acknowledgment of receipt of any damage due to transportation within eight (8) days following receipt. No claims will be accepted if these formalities are not followed. Apart from the possibility of the aforementioned claim, the actual delivery of the goods waives any claims regarding the number of items delivered or any apparent defects in the merchandise. Any order placed on the website and delivered outside of France may be subject to possible taxes and customs duties imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are the responsibility of the customer and fall under their responsibility.
The New Elisabeth is not obligated to verify or inform its customers regarding applicable customs duties and taxes. To know about them, it is the customer's responsibility to inquire with the competent authorities of their country.
Right of withdrawal :
Regarding custom-made products, there is no possibility of withdrawal; once the order is placed, no refunds will be made.
Refund :
Once the customer validates their order, no refunds will be issued.
Applicable Law :
These General Terms and Conditions are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction. In case of difficulty or complaint regarding an order, the customer can contact the following address to find an amicable solution: contact@thenewelisabeth.com
Information et Libertés :
The information collected by The New Elisabeth during a customer's order is necessary for managing the transaction and may be communicated in whole or in part to The New Elisabeth's service providers involved in executing the order. The customer is informed that this personal data may also be collected by an organization responsible for order analysis and combating credit card fraud.
